s 37Standard of proof

(1)

Any question of fact to be decided by a court in any proceeding for an offence under this Act or any regulation made thereunder shall be decided on the balance of probabilities.

(2)

Subsection (1) does not apply in relation to any question of fact that is for the prosecution to prove.
