96. Non-applicability of sections 93, 94 and 95

Sections 93, 94 and 95 do not apply to —

(a)

the Government;

Islamic Banking 90

(b)

any person licensed to carry on the business of a moneylender under section 3(1) of the Moneylenders Act

(Chapter 62);

(c)

any person licensed to carry on the business of a pawnbroker under the Pawnbrokers Order, 2002 (S 60/2002);

(d)

any co-operative society registered under the Co-operative

Societies Act (Chapter 84);

(e)

any finance company licensed under the

Finance Companies Act (Chapter 89);

(f)

the Tabung Amanah Islam Brunei Corporation established by section 3(1) of the Perbadanan Tabung Amanah Islam Brunei Act

(Chapter 163);

(g)

any bank licensed under the Banking Order, 2006

(S 45/2006);

(h)

any person registered under the Insurance Order, 2006

(S 48/2006) to carry on insurance business;

(i)

any Islamic bank licensed under this Act;

(j)

any operator licensed under the Takaful Order, 2008

(S 100/2008) to carry on takaful business;

(k)

any statutory body which is authorised under any written law to accept, receive or take deposits; and

(l)

any person related or associated with any person referred to in paragraphs (a), (b), (c), (d), (e), (f), (g), (h), (i), (j) and (k).
