s 45Questions to be decided by Court

At the inquiry, after receiving the report under section 43 or the certification of the officer in charge under section 44 and upon hearing such evidence and arguments as it may think fit, the Court shall decide —

(a)

whether the person alleged to be a mentally disordered person is, due to his mental disorder, incapable of managing himself and his affairs; and

(b)

any other questions as to which an inquiry has been directed.
