s 313Procedure when prisoner of unsound mind reported able to make defence

If such person is confined under section 308, and -

((I) such medical officers shall certify that in their opinion such person is capable of making his defence; and

(b)

the Chief Syar'ie Prosecutor shall certify that in his opinion it is in the public interest that the trial of such person shall proceed.

he shall be taken before the Syariah Court at such time as the Syariah Court appoints, and the Syariah Court if satisfied that such person is capable of making his defence shall proceed with the trial.
