Where a body corporate is guilty of an offence under this Act or any regulations made thereunder and the offence is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of, any director, manager, secretary or other similar officer of that body corporate or of any person purporting to act in any such capacity, he, as well as the body corporate, shall also be guilty of the offence and liable to be proceeded against and punished accordingly.

“Director” means the Director of Marine appointed under section 4 of the Merchant Shipping Order, 2002 and includes the Deputy Director of Marine;
